**ESTIMATE IS VALID FOR 30 DAYS**

INSURED AND BONDED AT:

 $2,000,000 policy.

PAYMENT TERMS AND DEPOSIT: Credit Cards must be on file for all landscape services prior to scheduling. Unless discussed by humble management.

A deposit of 40% is required for construction projects over $1500.00. Full payment shall be made upon completion of the described work or payment plan setup prior with credit card on file up to 12 months. There will be a flat fee of 10% added to final Invoice.

CONTRACT: If the customer has approved the estimate/contract then backs out for any reason, there is a 25% fee of the total contract price. 

LAWN MAINTENANCE: We may skip service to your property during the 26 weeks. For any of the reasons to keep your property healthy! lack of growth, lack of water, over watering. This will be a billable service under contract.

SNOW REMOVAL TERMS : Zero Tolerance Coverage includes 24/7 monitoring, high priority status, and safest conditions with the fastest response times. Professional snow removal service is designed to minimize risk and liability by promptly and safely removing snow from sidewalks, parking lots, steps, and stairs.

COMMERCIAL PROPERTIES : These are top priorities during snow events. 

All commercial snow contracts have a minimum truck per hour rate per visit.

The client is responsible for all extra hourly services. (Snow disposal services, City covered sidewalks removal after services are completed)

SALTING EVENTS: Commercial properties will be salted each event multiple times during storm if needed. Each time is billable unless discussed prior in the contract. 

SLIP & FALLS : Humble Services is not liable for slips or falls prior to the start of snow & ice events.

BREACH OF CONTRACT: If the client cancels the contract after signing the contract during the months of October to April. Seasonal customers are responsible for 75% of the remaining balance of the contract. Per push contracts will be billed 15 hours at stated hourly rate.

PLOW DAMAGES: We are not responsible for broken concrete, asphalt, cracks & potholes from any snow equipment. Commercial properties only - We will apply black dirt and re-seed damaged turf areas.

EQUIPMENT USED: Plows, Blowers, Shovels, Skid Loaders, Salt Spreaders 

RESIDENTIAL PROPERTIES: Credit card on file prior to services Seasonal all-inclusive contract for snow removal only. Salting is mandatory for all properties serviced by Humble Services. Per bag pricing will be added to the last 5 monthly payments. Per push snow contracts- some storms may take multiple visits to service completely each time we arrive, which is considered a new visit pricing. Properties will be serviced in a timely manner depending on the time of the storm. Some storms may take multiple visits to service completely. Drifting accumulation snow is charged as another service. Hours vary depending on the storm. 

DELAYED SERVICES: We have the right to delay response in poor visibility or when local government plows are taken off the roads.

CHRISTMAS LIGHTS: Custom c9's & 5mm lights warranty covered for 1 year materials only. Labor will be charged per hour. Warranty voided if lights burn out due to animals chewing on cords or power surges. Pictures will be taken prior to fixing. This will be charged as a service. Including time & materials.

LATE FEE: (50.00) dollars per month will be assessed to all invoices not received within (30) days after completion. After (60) days of no payment. We will start processing to small claims court. (All fees will be added to final invoice)

(150.00) Dollar fee will be assessed for any non sufficient funds (N.S.F.) checks. 

COST OF MATERIALS: The customer further agrees and understands that Humble Services is not responsible for fluctuations in the material market relative to availability, price or otherwise. The customer understands and agrees that these factors are beyond the control of Humble Services and issues relative thereto will not affect the viability of the remainder of this contract. 

COMPLETE AGREEMENT: This agreement contains all terms and conditions and describes all work to be performed. Any changes to this agreement must be in writing and signed by the Parties. No verbal changes prior to or after the execution hereof are binding on either party. 

The customer agrees that he/she is the responsible party for any and all liability as to his or her property. To that end, the customer does hereby release, acquit and forever discharge Humble Services and their heirs, executors, administrators, agents and assigns, and all other persons, forms, or corporations, liable or who might be claimed to be liable from any claims, demands, damages, actions, omissions, causes of action or suits of any kind or nature whatsoever, which occurred in regard to including but not limited to any contractual relationship between each party prior to this Agreement.

INDEMNIFICATION AND HOLD HARMLESS: The customer does hereby promise and agree to indemnify Humble Services, from and against any and all losses, claims, suits, damages or liabilities, of whatever kind or nature which Humble Services may sustain or to which it may become subject arising out of or relating to customers property, conduct, or actions while contracting with customer. 

GOVERNED BY MICHIGAN LAW: The laws of the State of Michigan shall govern this agreement and all rights and obligations hereunder, including matters of construction, validity, and performance. WAIVER: No waiver of any of the provisions of this agreement shall be deemed, or shall constitute, a waiver of any other provision, whether or not similar. No waiver shall constitute a continuing waiver. No waiver shall be binding unless executed in writing by the party charged with the waiver. 

SEVERABILITY: In the event any provision of this agreement shall be determined to be unlawful, such provision shall be deemed to be severed from this agreement and every other provision of this agreement shall remain in full force and effect. If, moreover, any one or more of the provisions contained in this agreement shall, for any reason be held to be excessively broad, it shall be construed, by limiting and reducing it, so as to be enforceable to the extent compatible with the applicable law as it shall then appear. I certify by my signature below that I have read and understood this agreement. Any changes to this agreement must be in writing and signed by the parties.
